Why Patent Translation Is Technically Demanding
Patent translation occupies the intersection of legal precision and technical subject-matter
expertise — two demands that are rarely fully satisfied by the same translator.
A patent document is simultaneously a legal instrument and a technical specification. The
claims section defines the legal scope of the protection — every word matters, because the
claims determine what is and is not protected. The description section explains the invention in technical detail — every technical term matters, because ambiguity in the description can be
used to narrow or invalidate the claims.
Translating a patent incorrectly in either dimension creates risk: Legal precision errors. Patent claims use a precise formal register that differs from ordinary
legal language. Terms like comprising, consisting of, and consisting essentially of have specific
and different legal meanings in patent claim drafting. A translator unfamiliar with patent claim
conventions will produce a translation that reads correctly but changes the scope of protection.
Technical accuracy errors. A patent for a mechanical device, a chemical compound, a
pharmaceutical formulation, or a software system requires a translator who understands the technology — not just the language it is described in. A chemical formula mistranslated, a
mechanical relationship incorrectly described, or a software architecture imprecisely rendered
creates prior art ambiguity or description insufficiency that may affect the validity of the patent.
Jurisdictional terminology. Patent systems differ by jurisdiction. The European Patent Office, the
EPO national validation process, PCT national phase entries, and national patent offices each
have their own procedural terminology and formal conventions. Translations for submission to patent offices must use the terminology those offices expect — not a generic legal equivalent.
